Jon Steinsapir was recently asked by World Intellectual Property Review to discuss the Trademark Trial and Appeal Board’s (TTAB) recent decision against Dr Dre in his trademark opposition against a gynecologist’s filings for a similar name. The TTAB ruled that the hip hop artist failed to prove that the mark “Doctor Drai” would cause confusion among the public as to the source of goods and services. According to Jon, Dr Dre would have had better luck suing for trademark infringement in a federal district court, and an appeal for this case would not likely be successful.
