The Wrap recently asked David Swift to comment on a possible defamation claim arising from a Twitter feud between actor Michael Rapaport and ESPN host Dan Le Batard. According to David, the latter’s claim that Rapaport has a sexually transmitted disease constitutes defamation per se, and the fact that the statement was made over social media is “not a defense.
“If anything, pursuing a defamation case based on libelous tweets is much simpler than an oral defamation case because there is no debate over exactly what was said,” says David.
